How long will it take to resolve my legal claim?
If you have suffered a brain or spinal cord injury as a result of an accident it will usually take an average of three to four years to resolve your case. However, there are many factors that go into resolving a case and your case could be resolved in as little as a few months or in more than five years.
A critical factor is the injury.
If the injured person is an adult, it generally takes at least two years for the experts to be able to tell us how well the person will recover. In order to properly value the case, we must have the medical advice to be able to determine what losses and needs the injured person will have long into the future.
If the injured person is a child, in many cases it takes years for the medical experts to be able to provide us with reliable advice about how the brain injury will impact that child’s future ability to be employed, live alone, or grow into an independent adult.
It also usually takes two to three years to get a trial date of adequate length to deal with a complex brain injury case. Obtaining a trial date can be a slow and frustrating process, but without a trial date and the expert report service deadlines set by the Rules of Court, most serious injury cases cannot resolve.
